The issue of the child’s right to be heard in German legislation is regulated in the Act on Proceedings in Family Matters and Voluntary Judiciary and in the Act on Voluntary Judiciary. Other supplementary provisions are contained in the following acts: Book Four of the German Civil Code – family law, the Act on the Organization of Common Courts and the Code of Civil Procedure. In this opinion, the author indicates the ways in which children’s rights can be heard by the family court. Discusses the legal regulations related to it, as well as the practice of its application. It also indicates and characterizes the institution of a child’s legal advocate.
