The issue of contact with parents after divorce is of great importance for the child’s psyche. They should be guaranteed the opportunity to use the facility with both parents. In Switzerland If the spouses have minor children, the court takes the necessary measures regarding divorce and establishing contact with the child. In addition, the family court regulates parental care, regarding custody of the child, the method of regulating personal contacts with the child, and the amount of alimony. Its task is to take into account all circumstances relevant to the child’s well-being, including the parents’ requests and, if possible, the child’s opinions.
The author also points to international law, such as the UN Convention on the Rights of the Child, as well as the case law of the European Court of Justice, which refers to the above issues. As part of the study, the Professor characterizes the issue of parental authority and custody over the joint child, the principle of the child’s best interests as the superior principle in case law, the issue of alternating custody of the joint child and exclusive custody of the child, as well as child maintenance.
